Towing Transparency & Accountability signed into law – SB617

NHMTA is pleased to report that legislation designed to crack down on predatory towing has been signed into law by Governor Ayotte. Predatory towing occurs when a tow company egregiously overcharges a vehicle owner for a tow ordered by law enforcement due to a vehicle breakdown or accident. Recently, NHMTA members fell victim to this and have received bills for tens of thousands of dollars for such tows. Accordingly, it became necessary to pursue legislation.

SB 617 will bring transparency and accountability regarding the cost of these tows.

SB 617 contains a number of provisions, but the following were advocated by NHMTA:

• Increases length of time allowed for appealing the towing invoice
  • Previously, the law allowed for a 15 day window to appeal. Now, that will increase to 30 days from “receipt of the invoice.”
• Allows for appeal of towing charges before paying the invoice
  • Previously, vehicle owners would have to pay the towing invoice before appealing. Now, they will be able to appeal the invoice amount before paying.
• Requires the towing invoices to indicate the appeals process
  • The new law created by SB 617 states: “An invoice for towing or storage of a motor vehicle shall clearly indicate the process for appealing the reasonableness of such charges.  Such notice shall be provided on the invoice and may include an Internet website address or scannable code linking to additional information”

These provisions will become effective January 1, 2027. Additionally, there is another provision included in the legislation which will take effect on that same date.

• No more secrecy for towing company rates.
  • Previously, the law held that “Price lists shall remain confidential except when determining the reasonable fee in a requested hearing conducted by the department of safety.” This language will be gone on January 1, 2027.
